1. Scope

These terms apply to all contracts for the use of the "zugengo" software between Konrad Jaritz (Hector Schuech), Rosenweg 8a/6, 9535 Schiefling am Wörthersee, Austria ("Provider"), and its customers ("Customer").

2. Description of services

zugengo is an accessibility widget that can be embedded via a script tag, improving the usability of a website for its visitors (including contrast modes, screen reader, voice control, mouse grid, smart navigation, accessibility profiles, custom color settings).

      zugengo improves a website's accessibility but does not replace a
      complete legal accessibility audit (e.g. under WCAG 2.1 AA or the European
      Accessibility Act). Whether a website fully meets legal requirements
      depends on the website as a whole and is the customer's responsibility.
    

3. Conclusion of contract

The contract is concluded by completing the order process on the payment page provided by zugengo (Stripe Checkout). Upon completion, the customer automatically receives a personal license key for the domain provided.

4. Prices, trial period and payment

zugengo is offered in three term options (monthly, annual, or 2 years), each at the price shown on zugengo.eu at the time of order (currently €24 per month, €240 per year, or €480 for 2 years, each per domain). Each option begins with a free 14-day trial period. No amount is charged during this time; the customer may cancel at any time via the customer portal at no cost. If not cancelled, the first charge at the chosen price occurs after the trial period ends. The Provider is a small business ("Kleinunternehmer") under § 6 (1) no. 27 of the Austrian VAT Act; invoices therefore do not show VAT. Payment processing is handled by Stripe.

5. Contract term, automatic renewal and cancellation

The subscription renews automatically unless cancelled:

Monthly plan: renews for 1 month at a time.
Annual plan: renews for 1 year at a time.
2-year plan: initial term of 2 years. After this initial term, the subscription does not renew for another 2 years, but renews for 1 year at a time at the then-current annual price.

Cancellation is possible at any time, effective at the end of the current billing period, via the customer portal provided to the customer. After cancellation, the license key remains active until the end of the already paid period and is then automatically deactivated.

6. Right of withdrawal for consumers

Consumers generally have the right to withdraw from the contract within 14 days without giving reasons. Since the subscription begins with a free 14-day trial period and payment only occurs afterwards, the customer can cancel free of charge at any time within this period; no payment that would need to be refunded is ever made in this case. In practice, a withdrawal is therefore straightforward and without financial consequences throughout the entire trial period.

7. Usage rights

For the duration of the subscription, the customer receives a simple, non-transferable right to embed and use the zugengo script on the domain specified at the conclusion of the contract. Passing on the license key to third parties or using it on additional domains without an additional license is not permitted.

8. Availability and warranty

The Provider makes reasonable efforts to ensure high availability of the service but cannot guarantee uninterrupted availability (e.g. during maintenance or disruptions beyond its control). Statutory warranty rights remain unaffected.

9. Liability

The Provider is liable without limitation for intent and gross negligence, as well as under the mandatory provisions of the Austrian Product Liability Act. For slight negligence, the Provider is only liable for breach of material contractual obligations, and liability is limited to the foreseeable, typical damage for this type of contract. Liability for the customer's website fully meeting all statutory accessibility requirements as a result of using zugengo is excluded (see section 2).

11. Changes to these terms

The Provider reserves the right to amend these terms with effect for the future. Customers will be informed of material changes in good time.

12. Final provisions

Austrian law applies, excluding the UN Convention on Contracts for the International Sale of Goods. For contracts with consumers, mandatory consumer protection provisions of the consumer's country of residence remain unaffected. The place of jurisdiction for disputes with business customers is Klagenfurt, Austria. The European Commission provides a platform for online dispute resolution: ec.europa.eu/consumers/odr.
